Welcome to ChangeDog!

These Terms of Service ("Terms") govern your use of the ChangeDog platform at https://changedog.top ("Platform") and all services provided by ChangeDog. By accessing or using our Platform, you agree to be bound by these Terms.

1. Description of ChangeDog

ChangeDog is an AI-powered SaaS platform that provides:

- Automated changelog generation from Git commits using artificial intelligence
- User feedback collection through embeddable widgets
- Public changelog pages with custom subdomains
- GitHub and GitLab webhook integration
- Weekly digest email subscriptions
- Knowledge base functionality with AI chatbot support
- Real-time notifications and updates

2. Account Registration and Authentication

To use ChangeDog, you must create an account by authenticating through one of the following methods:

- GitHub OAuth
- GitLab OAuth
- Google OAuth
- Email magic link

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access to your account.

You agree to provide accurate and complete information during registration and to keep this information up to date.

3. Subscription Plans and Billing

ChangeDog offers multiple subscription tiers:

Free Plan:
- 1 project
- 500 widget views per month
- Basic changelog features
- "Powered by ChangeDog" badge required on widget
- Community support

Solo Plan ($5/month):
- Unlimited projects
- 10,000 widget views per month
- AI changelog generation
- Weekly digest emails
- Custom branding (no badge requirement)
- Priority support

Team Plan ($15/month):
- Everything in Solo plan
- Unlimited widget views
- Team roles and permissions
- Advanced analytics
- SSO integration
- Custom integrations

Billing:
- Subscriptions are billed monthly through Stripe
- Payment is due at the beginning of each billing cycle
- You can upgrade, downgrade, or cancel your subscription at any time through the Stripe Customer Portal
- Quota usage resets monthly on your billing date

4. Usage Quotas and Limitations

Your plan includes specific usage quotas:

- Widget Views: The number of times your embedded widget is displayed on external websites
- Projects: The number of projects you can create (Free: 1, Solo/Team: unlimited)

When you reach 80% of your quota, we will display a warning banner in your dashboard. If you exceed your quota:

- Widget continues to work in read-only mode
- You will be prompted to upgrade your plan
- We reserve the right to limit service access until quota compliance is restored

5. Data Ownership and Usage Rights

Your Data:
- You retain all ownership rights to your content, including projects, changelogs, feedback, and user-generated content
- You grant us a limited license to use your data solely to provide and improve our services
- You can export your data in CSV format at any time
- You can delete your account and all associated data through GDPR deletion request

AI Processing:
- By using our AI features, you authorize us to send your commit messages and feedback content to OpenAI's GPT-4 API for processing
- AI-generated content suggestions are provided as-is and should be reviewed before publishing

Widget Embedding:
- You have the right to embed our widget on any website you own or have permission to modify
- The widget must not be used for illegal purposes or to collect data in violation of privacy laws

6. Prohibited Uses

You agree not to:

- Use the service for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Use automated systems (bots, scrapers) to access the service without permission
- Resell or redistribute the service without authorization
- Upload malicious code, viruses, or harmful content
- Violate intellectual property rights of others
- Spam or send unsolicited communications through our service
- Abuse rate limits or attempt to overload our systems

7. Webhook Integration and Repository Access

When you connect GitHub or GitLab repositories:

- We only request read-only access to your repositories
- Webhook secrets are stored securely and used only for signature verification
- We do not modify your repository code or settings
- You can revoke access at any time through your OAuth provider settings

8. Service Availability and Support

We strive to maintain 99.5% uptime but do not guarantee uninterrupted service. We reserve the right to:

- Perform scheduled maintenance with advance notice
- Temporarily suspend service for emergency maintenance
- Modify or discontinue features with reasonable notice

Support is provided based on your plan:
- Free: Community support via email
- Solo/Team: Priority email support
- Response times are not guaranteed but we aim to respond within 48 hours

9. Refund Policy

We offer refunds under the following conditions:

- Full refund within 7 days of initial subscription purchase
- No refund for renewals or subsequent billing cycles
- Refunds are processed through Stripe and may take 5-10 business days

10. Intellectual Property

The ChangeDog platform, including all code, design, branding, and documentation, is owned by ChangeDog and protected by intellectual property laws.

You may not:
- Copy, modify, or create derivative works of our platform
- Use our branding or trademarks without permission
- Remove copyright or proprietary notices

11. Privacy and Data Protection

We are committed to protecting your privacy. Our Privacy Policy at https://changedog.top/privacy-policy explains how we collect, use, and protect your data.

We comply with GDPR and provide:
- Data access and export tools
- GDPR deletion requests
- Double opt-in for email subscriptions
- No third-party tracking on public pages

12. Third-Party Services

Our platform integrates with third-party services including:

- OpenAI (AI processing)
- Stripe (payment processing)
- Resend (email delivery)
- MongoDB Atlas (data storage)
- Vercel (hosting)
- GitHub/GitLab (OAuth and webhooks)

Your use of these services is also subject to their respective terms of service.

13. Liability and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- The service is provided "AS IS" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the last 12 months
- We are not responsible for data loss (you should maintain backups)
- We are not liable for third-party service failures

14. Indemnification

You agree to indemnify and hold harmless ChangeDog from any claims, damages, or expenses arising from:

- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the platform

15. Termination

We may suspend or terminate your account if you:

- Violate these Terms
- Engage in fraudulent activity
- Fail to pay subscription fees
- Abuse the service or other users

Upon termination:
- Your access to the service will be revoked
- Your data will be retained for 30 days for recovery
- After 30 days, your data will be permanently deleted
- You can export your data before termination

You may terminate your account at any time through account settings.

16. Changes to Terms

We may update these Terms from time to time. When we make material changes:

- We will update the "Last Updated" date
- We will notify you via email
- Continued use of the service constitutes acceptance of new terms
- If you don't agree to new terms, you must stop using the service

17. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes will be resolved through:

1. Good faith negotiation
2. Binding arbitration if negotiation fails
3. Litigation only as a last resort

You agree to resolve disputes individually and waive any right to class action lawsuits.

18. Miscellaneous

Severability: If any provision is found invalid, the remaining provisions continue in effect.

Entire Agreement: These Terms constitute the entire agreement between you and ChangeDog.

No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.

Assignment: You may not assign these Terms. We may assign them to any successor.
